Article 1 — Purpose and Scope

These General Terms and Conditions of Sale (hereinafter "T&Cs") apply, without restriction or reservation, to all sales concluded by Agathe Lanza (hereinafter "the Seller") with any consumer or non-professional buyer (hereinafter "the Customer") wishing to purchase the products offered for sale (hereinafter "the Products") on the website www.jailacote.com (hereinafter "the Website").

These T&Cs are available at all times on the Website and shall prevail, where applicable, over any other version or conflicting document. The Customer is deemed to have accepted them without reservation upon validating their order.

The Seller reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in force at the date of the order.

Article 2 — Products

The Products offered for sale are described on the Website as accurately as possible, particularly with regard to their essential characteristics, availability, and price.

Photographs and visuals presenting the Products on the Website are not part of the contractual scope. In the event of a manifest error or omission, the Seller's liability cannot be engaged.

Product offers are valid while stocks last. If a Product becomes unavailable after an order has been placed, the Customer will be informed as soon as possible and may choose between cancellation and full refund, or exchange for an equivalent product.

Article 3 — Prices

Product prices are indicated in euros (€), inclusive of all taxes (VAT included), and reflect the VAT rate applicable on the date of the order. Any change in the applicable rate will be immediately reflected in Product prices.

Prices do not include delivery costs, which are charged separately and displayed before order validation.

The Seller reserves the right to modify prices at any time. Products will be invoiced based on the rates in force at the time the order is recorded.

Article 4 — Placing an Order

To place an order, the Customer must:

  • Select the desired Products and add them to the cart;
  • Check the contents of their cart (quantities, references, prices);
  • Enter their delivery and billing details;
  • Choose their delivery method;
  • Choose their payment method;
  • Review their order summary;
  • Accept these T&Cs by ticking the relevant box;
  • Confirm payment.

The order is only definitively recorded once payment has been confirmed. A confirmation email summarising the order details is sent to the Customer at the email address provided.

The Seller reserves the right to refuse or cancel any order from a Customer with whom a dispute exists regarding a previous order, or in cases of suspected fraud.

Article 5 — Payment

Purchases are paid for online using the payment methods available on the Website (including credit/debit card, PayPal, or any other method displayed at checkout). All payments are secure.

Payment is debited upon order validation. In the event of a declined payment authorisation, the order is automatically cancelled and the Customer is notified by email.

The Customer warrants that they are fully authorised to use the payment method provided at the time of ordering and that the payment method provides access to sufficient funds to cover the full order amount.

Article 6 — Delivery

Delivery terms (timeframes, costs, geographical coverage) are detailed in the Shipping Policy available on the Website.

The risk of loss or damage to the Products is transferred to the Customer from the moment they, or a third party designated by them, physically takes possession of the Products.

Article 7 — Transfer of Ownership

Ownership of the Products will only transfer to the Customer once full payment has been received by the Seller, regardless of the delivery date.

Article 8 — Right of Withdrawal

The Customer has the right to withdraw from their purchase within fourteen (14) calendar days of receiving their order, in accordance with Articles L. 221-18 and following of the French Consumer Code.

The conditions for exercising this right, as well as the return and refund procedures, are described in detail in the Return and Refund Policy available on the Website.

Article 9 — Legal Guarantees

Independently of the right of withdrawal, the Customer benefits from the following legal guarantees:

9.1 — Legal Guarantee of Conformity

In accordance with Articles L. 217-4 to L. 217-14 of the French Consumer Code, the Seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. In the event of a lack of conformity, the Customer may request repair or replacement of the goods, or failing that, a price reduction or cancellation of the contract.

9.2 — Guarantee Against Hidden Defects

In accordance with Articles 1641 and following of the French Civil Code, the Seller is liable for hidden defects in the sold goods that render them unfit for their intended use, or that so significantly diminish that use that the buyer would not have purchased them, or would have paid a lower price, had they been aware of such defects.

For any claim under these guarantees, the Customer must contact the Seller at contact@jailacote.com.

Article 10 — Liability

The Seller's liability cannot be invoked if the non-performance or delay in performance of any of their obligations under these T&Cs results from a case of force majeure as defined by French case law.

The Seller shall not be held liable for any damage resulting from improper use of the purchased Product.

Article 11 — Mediation and Dispute Resolution

In the event of a dispute between the Customer and the Seller, both parties will endeavour to reach an amicable resolution.

Failing an amicable agreement, the consumer Customer may refer the matter free of charge to a consumer mediator, in accordance with Articles L. 611-1 and following of the French Consumer Code. They may also use the European online dispute resolution platform, accessible at: https://ec.europa.eu/consumers/odr

Failing an amicable resolution, any dispute will be submitted to the competent courts under the conditions of common law.

Article 12 — Applicable Law

These T&Cs and the transactions arising therefrom are governed by and subject to French law.
